§ 9.28.020. Possessing one ounce or less of marijuana.

A.

It is unlawful for any person intentionally to possess one (1) ounce or less of marijuana, as defined in Subsection 9.28.010(A).

B.

Any person who violates this section shall be punished by a fine of not less than fifty dollars (50.00) or more than one hundred dollars ($100.00) and by imprisonment for not more than fifteen (15) days, or both, for the first offense.

C.

Any person who violates this section shall be punished by a fine of not less than one hundred dollars ($100.00) or more than five hundred dollars ($500.00), and by imprisonment for not more than ninety (90) days, or both, for the second or subsequent offenses.
