§ 9.28.030. Possessing Salvia divinorum.

  • A.

    It is unlawful for any person intentionally to possess Salvia divinorum, as defined in Subsection 9.28.010(A).

    B.

    Any person who violates this section shall be punished by a fine of not less than fifty dollars (50.00) or more than one hundred dollars ($100.00) and by imprisonment for not more than fifteen (15) days, or both, for the first offense.

    C.

    Any person who violates this section shall be punished by a fine of not less than one hundred dollars ($100.00) or more than five hundred dollars ($500.00), and by imprisonment for not more than ninety (90) days, or both, for the second or subsequent offenses.
